Ask Officer Raff: Hi Officer Raff, I read your article titled "Back to School Safety Reminders" in the September 2024 issue of CTNL. I thought it was a very good article. My question is, what exactly does "When Children are Present" mean on school zone speed limit signs? An example would be on Cokesbury Road near the Round Valley School. This school building sits quite a distance from the road. Does it mean when school is in session? Does it mean when children are visible near the road? Is it only when school buses are entering or leaving the school driveway? (When a speed limit sign near a school has blinking lights, they only come on when buses are entering or leaving.) Best Regards, Gerry D. Hi Gerry, First, thank you for reading and taking the time to write with such a great question! School Zone speed limits are addressed in New Jersey Motor Vehicle Statutes, specifically Statute 39:4-98 a.(1) which states that vehicles shall travel twenty-five miles per hour, when passing through a school zone during recess, when the presence of children is clearly visible from the roadway, or while children are going to or leaving school, during opening or closing hours. So essentially, during hours that school is open, when children are clearly visible from the roadway and during hours of arrival and dismissal, to include delayed opening and early dismissal. With that being said, there are other times, such as after school hours or on weekends, during sports seasons when children may be visible on school property. If you are ever unsure if the presence of children triggers the reduced speed, I counsel drivers to err on the side of caution and slow to the School Zone speed limit, rather than risk injuring children or receiving a summons.
