"It is a wise father that knows his own child." –William Shakespeare Music Under the S ta r s C o n c e r t S e r i e s Presented by The Hunterdon County Division of Parks & Recreation S o c i a l H o s t O b l i g at i o n s Nothing says summer quite like getting together with friends and family and firing up your backyard barbecue. Such festivities generally include the obligatory burgers, hot dogs, potato salad and beer. With the serving of alcoholic beverages at these gatherings, you, as the social host, may become subject to liabilities should one of your guests cause injury or damage as a result of the consumption occurring on your property. New Jersey Statute* provides that damages may be recovered from a social host if the host "willfully and knowingly" provided alcoholic beverages to a person who is either visibly intoxicated in their presence or who displays behavior that could result in a reckless disregard of consequences where that displayed behavior could affect the life or property of another. It is the obligation of a social host to exercise reasonable care to avoid foreseeable risks of harm to the life and/or property of another. While "visible intoxication" is a factor in determination of liability, the Blood Alcohol Content of the intoxicated person is the measure relied upon for determining intoxication, with a BAC level of at least 0.10% but less than 0.15% creating a rebuttable presumption of negligence on the part of a social host. It is of importance to note that the statute applies to an intoxicated person of legal age to consume alcoholic beverages. As you enjoy your next barbecue with your friends, please remember to do so responsibly. *N.J.S.A. 2A:15.-5.6 Free, open air "Music Under the Stars" concerts will be held each Thursday, June 27 through August 15, except the July 4 concert, which will be on held on Wed., July 3.
