It can keep your family "intact" even though you will ultimately be living in two different households. Rosalyn A. Metzger, Esq., family law mediator with Rotolo Karch Law, addresses some common questions associated with mediation. How does mediation work? The mediator will meet with both of you and give you a little of his or her background so that you are aware of whether this is their first or 251st mediation. The mediator should explain the process so you know what to expect... and often will ask each of you questions to help you get started. Alternatively, if you know what you want to say, you are invited to state your goals and objectives in the mediation process. How are financial issues handled? You and your spouse will need to assemble financial statements, preferably from the same end date so that the values come from the same time frame. It is helpful if a financial advisor provides assistance so there are no surprises after you reach final agreement. And the children? New Jersey links child support to the amount of time the children share with each parent. In mediation you can separate those two issues so that money is not the guiding factor. There are many ways to put the children first and mediation allows you to do that with a great deal of thought, consideration and compassion. How long will it take? That depends on how well you and your other half can address the issues, and how well prepared you are when you attend mediation. I have worked with clients who were finished in six weeks, and others who chose to wait a year and a half. It's entirely up to you. In closing: I encourage you to consider mediation to resolve all of your disputes, whether divorce or other family issues, such as estate litigation. – Rosalyn A.
