F i r e wo r k s The Fourth of July is right around the corner and, while it might be tempting to make the short trek over the Pennsylvania border to procure fireworks to mark the celebration of Independence Day, be mindful that the transport and possession of fireworks across and within state boundaries is against the law in New Jersey. The seemingly innocuous sparkler or firecracker can result in fines and penalties as well as threats to physical safety. Only paper and plastic caps, like those used in toy guns, are permitted in New Jersey. Be prepared to face the following fines and penalties in connection with the possession, use or sale of fireworks: • Possession and/or discharge of fireworks may subject you to a fine of up to $1,000 as well as up to 30 days in jail. • Sale and/or intent to sell fireworks is subject to a fine of up to $10,000 as well as up to 18 months in jail. The legality of fireworks aside, the safety issues of their use should also be considered. In 2011, the U.S. Consumer Product Safety Commission ("CPSC") conducted a study of fireworks-related injuries* covering the period of June 17 through July 17. The CPSC study revealed: • On average, 200 people go to the emergency room every day with fireworks-related injuries during the month surrounding the July 4 holiday. • The most injured body parts were hands and fingers (46%), eyes, heads, faces and ears (17%); more than half of the injuries resulting from burns. • The percentage of injuries resulting from sparklers was 17% and firecrackers was 13%. Celebrate your patriotism safely and legally by leaving the display of fireworks to the professionals.
